  1                      A bill to be entitled

  2         An act relating to motorcycles and motor-driven

  3         cycles; requiring passenger footrests and

  4         handholds on such cycles; limiting the height

  5         of handlebars; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8  

  9         Section 1.  (1)  A motorcycle or motor-driven cycle

10  that is carrying a passenger, other than in a sidecar or

11  enclosed cab, must be equipped with passenger footrests and

12  handholds.

13         (2)  A motorcycle or motor-driven cycle may not be

14  operated if the handlebars are higher than the operator's

15  shoulders when the operator is properly seated on the cycle.

16         (3)  A violation of this section is a noncriminal

17  traffic infraction, punishable as a nonmoving violation as

18  provided in chapter 318, Florida Statutes.

19         Section 2.  This act shall take effect July 1, 2005.
