1 A bill to be entitled
2 An act relating to postsecondary athletics;
3 providing that it is a third-degree felony for
4 a person to solicit or accept any thing of
5 value from an employee or representative of a
6 public postsecondary educational institution
7 for the purpose of encouraging a student to
8 enroll in such institution in order to compete
9 in intercollegiate athletic events; providing
10 that the act does not prohibit actions
11 otherwise permitted by a rule or regulation
12 governing the recruitment of athletes by
13 postsecondary educational institutions;
14 providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. Remuneration from employee or
19 representative of educational institution for encouraging a
20 student to enroll to compete in athletic events prohibited;
21 penalty.--
22 (1) A person may not solicit or accept remuneration or
23 any other thing of value from an employee or representative of
24 a public postsecondary educational institution for the purpose
25 of encouraging a student to enroll in such educational
26 institution in order to compete in intercollegiate athletic
27 events.
28 (2) A person who violates subsection (1) commits a
29 felony of the third degree, punishable as provided in section
30 775.082, section 775.083, or section 775.084, Florida
31 Statutes.

1 (3) The provisions of this section do not apply to the
2 offer of a scholarship, the provision of an item, or the
3 compensation for an expense which is specifically permitted
4 under a rule or regulation governing the recruitment of
5 athletes by postsecondary educational institutions unless the
6 rule or regulation is in violation of any law of this state or
7 any federal law.
8 Section 2. This act shall take effect July 1, 2005.

11 SENATE SUMMARY
12 Provides that soliciting or accepting any thing of value
from an employee or representative of a public
13 postsecondary educational institution for the purpose of
encouraging a student to enroll in such institution in
14 order to compete in intercollegiate athletic events is a
third-degree felony.
