4     Between lines 77 and 78 insert:
5     Section 2.  Section 810.14, Florida Statutes, is amended to
6read:
7     810.14  Voyeurism prohibited; penalties.--
8     (1)  A person commits the offense of voyeurism when he or
9she, with lewd, lascivious, or indecent intent, secretly
10observes, photographs, films, videotapes, or records another
11person when the such other person is located in a dwelling,
12structure, or conveyance and such location provides a reasonable
13expectation of privacy.
14     (2)  A person who violates this section commits a
15misdemeanor of the first degree for the first violation,
16punishable as provided in s. 775.082 or s. 775.083.
17     (3)  A person who violates this section and who has been
18previously convicted or adjudicated delinquent two or more times
19of any violation of this section commits a felony of the third
20degree, punishable as provided in s. 775.082, s. 775.083, or s.
21775.084.
22     (4)  For purposes of this section, a person has been
23previously convicted or adjudicated delinquent of a violation of
24this section if the violation resulted in a conviction sentenced
25separately, or an adjudication of delinquency entered
26separately, prior to the current offense.

31An act relating to criminal offenses; amending s. 810.02,
32F.S.; providing enhanced penalties for specified
33burglaries that are committed during a state of emergency;
34providing that a person arrested for committing a burglary
35during a state of emergency may not be released until that
36person appears before a magistrate at a first-appearance
37hearing; directing that a felony burglary committed during
38a state of emergency be reclassified one level above the
39current ranking of the offense committed; amending s.
40810.14, F.S.; revising the elements of the offense of
41voyeurism in order to eliminate acts of photographing,
42filming, videotaping, or recording, which are made a crime
43under the offense of video voyeurism; providing that a
44person commits the offense of voyeurism when he or she
45secretly observes another person while the other person is
46in a location that provides a reasonable expectation of
47privacy; amending s. 812.014, F.S.; providing enhanced
48penalties for the theft of certain property stolen during
49a state of emergency; directing that a felony theft
50committed during a state of emergency be reclassified one
51level above the current ranking of the offense committed;
52providing an effective date.
