13 Senate Amendment (with title amendment)
14 On page 12, lines 4 through 9, delete those lines
15
16 and insert:
17 Section 2. If any provision of section 1 of this act
18 or its application to any person or circumstance is held
19 invalid, the invalidity does not affect other provisions or
20 applications of the act which can be given effect without the
21 invalid provision or application, and to this end the
22 provisions of this act are severable.
23 Section 3. Subsection (7) of section 288.1162, Florida
24 Statutes, is amended to read:
25 288.1162 Professional sports franchises; spring
26 training franchises; duties.--
27 (7)(a) The Office of Tourism, Trade, and Economic
28 Development shall notify the Department of Revenue of any
29 facility certified as a facility for a new professional sports
30 franchise or a facility for a retained professional sports
31 franchise or as a facility for a retained spring training

1 franchise. The Office of Tourism, Trade, and Economic
2 Development shall certify no more than eight facilities as
3 facilities for a new professional sports franchise or as
4 facilities for a retained professional sports franchise and
5 shall certify at least five as facilities for retained spring
6 training franchises, including in such total any facilities
7 certified by the Department of Commerce before July 1, 1996.
8 The office may make no more than one certification for any
9 facility. The office may not certify funding for less than
10 the requested amount to any applicant certified as a facility
11 for a retained spring training franchise.
12 (b) Certification of an applicant under this section
13 for the eighth certification for a facility for a new
14 professional sports franchise or for a facility for a retained
15 professional sports franchise shall be for an applicant for
16 which the franchise that serves as the basis of the
17 certification is a member of the National Basketball
18 Association, has been located within this state since 1987,
19 and has not been previously certified. This paragraph expires
20 July 1, 2010.
