19 Section 46. Subsection (1) of section 101.657, Florida
20 Statutes, is amended, present subsection (2) of that section
21 is renumbered as subsection (4), and new subsections (2) and
22 (3) are added to that section, to read:
23 101.657 Early voting.--
24 (1)(a) As a convenience to the voter, the supervisor
25 of elections shall allow an elector to vote early in the main
26 or branch office of the supervisor by depositing the voted
27 ballot in a voting device used by the supervisor to collect or
28 tabulate ballots. In order for a branch office to be used for
29 early voting, it shall be a permanent full-service facility of
30 the supervisor and shall have been designated and used as such
31 for at least 1 year prior to the election. The supervisor may

1 also designate any city hall or permanent public library
2 facility as early voting sites; however, if so designated, the
3 sites must be geographically located so as to provide all
4 voters in the county an equal opportunity to cast a ballot,
5 insofar as is practicable. The results or tabulation of votes
6 cast during early voting may not be made before the close of
7 the polls on election day. Results shall be reported by
8 precinct.
9 (b) The supervisor shall designate each early voting
10 site by no later than the 30th day prior to an election and
11 shall designate an early voting area, as defined in s. 97.021,
12 at each early voting site. Designation of early voting sites
13 may not be changed except by petition to the division, which
14 petition shall only be granted for reasons of a natural or
15 unavoidable event resulting in the unavailability of such
16 early voting site.
17 (c) All early voting sites in a county shall be open
18 on the same days for the same amount of time and shall allow
19 any person in line at the closing of an early voting site to
20 vote.
21 (d)(b) Early voting shall begin on the 15th day before
22 an election and end on the 2nd day before an election. For
23 purposes of a special election held pursuant to s. 100.101,
24 early voting shall begin on the 8th day before an election and
25 end on the 2nd day before an election. Early voting shall be
26 provided for at least 8 hours per weekday and 8 hours in the
27 aggregate each weekend at each site during the applicable
28 periods. Early voting sites shall open no sooner than 7 a.m.
29 and close no later than 7 p.m. on each applicable day during
30 the applicable periods. Early voting shall also be provided
31 for 8 hours in the aggregate for each weekend during the

1 applicable periods.
2 (e) Notwithstanding the requirements of s. 100.3605,
3 municipalities may provide early voting in municipal elections
4 that are not held in conjunction with county or state
5 elections. If a municipality provides early voting, it may
6 designate as many sites as necessary and shall conduct its
7 activities in accordance with the provisions of paragraphs
8 (a)-(c). The supervisor is not required to conduct early
9 voting if it is provided pursuant to this subsection.
10 (f) Notwithstanding the requirements of s. 189.405,
11 special districts may provide early voting in any district
12 election not held in conjunction with county or state
13 elections. If a special district provides early voting, it may
14 designate as many sites as necessary and shall conduct its
15 activities in accordance with the provisions of paragraphs
16 (a)-(c). The supervisor is not required to conduct early
17 voting if it is provided pursuant to this subsection.
18 (2) During any early voting period, each supervisor of
19 elections shall make available the total number of voters
20 casting a ballot at each early voting location during the
21 previous day. Each supervisor shall prepare an electronic data
22 file listing the individual voters who cast a ballot during
23 the early voting period. This information shall be provided in
24 electronic format as provided by rule adopted by the division.
25 The information shall be updated and made available no later
26 than noon of each day and shall be contemporaneously provided
27 to the division.
28 (3) The ballot of each elector voting early shall be
29 counted even if the elector dies on or before election day.
