17 insert:
18 Section 2. Subsections (5), (6), and (7) of section
19 218.65, Florida Statutes, are amended to read:
20 218.65 Emergency distribution.--
21 (5) At the beginning of each fiscal year, the
22 Department of Revenue shall calculate a base allocation for
23 each eligible county equal to the difference between the
24 current per capita limitation times the county's population,
25 minus prior year ordinary distributions to the county pursuant
26 to ss. 212.20(6)(d)3., 218.61, and 218.62. If moneys deposited
27 into the Local Government Half-cent Sales Tax Clearing Trust
28 Fund pursuant to s. 212.20(6)(d)4., excluding moneys
29 appropriated for supplemental distributions pursuant to
30 subsection (7), for the current year are less than or equal to
31 the sum of the base allocations, each eligible county shall

1 receive a share of the appropriated amount proportional to its
2 base allocation. If the deposited amount exceeds the sum of
3 the base allocations, each county shall receive its base
4 allocation, and the excess appropriated amount, less any
5 amounts distributed under subsection (6), shall be distributed
6 equally on a per capita basis among the eligible counties.
7 (6) If moneys deposited in the Local Government
8 Half-Cent Sales Tax Clearing Trust Fund pursuant to s.
9 212.20(6)(d)4. exceed the amount necessary to provide the base
10 allocation to each eligible county, the moneys in such trust
11 fund may be used to provide a transitional distribution, as
12 specified in this subsection, to certain counties whose
13 population has increased. The transitional distribution shall
14 be made available to each county that met the eligibility
15 criteria in subsection (2) in the prior year but does not,
16 because the population in the county increased to more than
17 65,000, meet such criteria in the current year. Beginning on
18 July 1 of the year following the year in which the population
19 in such a county exceeds 65,000, the county shall receive
20 two-thirds of the amount it received in the prior year and
21 beginning July 1 of the second year following the year in
22 which the population in such a county exceeds 65,000, the
23 county shall receive one-third of the amount it received in
24 the last year in which the county's population was less than
25 65,000. If insufficient moneys are available in the Local
26 Government Half-Cent Sales Tax Clearing Trust Fund to fully
27 provide such a transitional distribution to each county that
28 meets the eligibility criteria in this subsection, each
29 eligible county shall receive a share of the available moneys
30 which is proportional to the amount it would have received had
31 moneys been sufficient to fully provide such a transitional

1 distribution to each eligible county.
2 (7)(6) There is hereby annually appropriated from the
3 Local Government Half-cent Sales Tax Clearing Trust Fund the
4 distribution provided in s. 212.20(6)(d)4. to be used for
5 emergency and supplemental distributions pursuant to this
6 section.
7 (8)(7)(a) Any county the inmate population of which in
8 any year is greater than 7 percent of the total population of
9 the county is eligible for a supplemental distribution for
10 that year from funds expressly appropriated therefor. At the
11 beginning of each fiscal year, the Department of Revenue shall
12 calculate a supplemental allocation for each eligible county
13 equal to the current per capita limitation pursuant to
14 subsection (4) times the inmate population of the county. If
15 moneys appropriated for distribution pursuant to this section
16 for the current year are less than the sum of supplemental
17 allocations, each eligible county shall receive a share of the
18 appropriated amount proportional to its supplemental
19 allocation. Otherwise, each shall receive an amount equal to
20 its supplemental allocation.
21 (b) For the purposes of this subsection, the term:
22 1. "Inmate population" means the latest official state
23 estimate of the number of inmates and patients residing in
24 institutions operated by the Federal Government, the
25 Department of Corrections, or the Department of Children and
26 Family Services.
27 2. "Total population" includes inmate population and
28 noninmate population.
