1 A bill to be entitled
2 An act relating to construction costs for
3 school facilities; amending s. 1013.64, F.S.;
4 revising provisions relating to annual
5 adjustments in the maximum allowable
6 construction cost per student station;
7 specifying that certain costs are not included
8 in the cost per student station; authorizing
9 the Commissioner of Education to adopt rules
10 relating to waivers from certain requirements
11 pertaining to cost ceilings for specialized
12 education centers and rules allowing specified
13 costs to be deducted from the cost per student
14 station; providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:
17
18 Section 1. Paragraphs (b) and (d) of subsection (6) of
19 section 1013.64, Florida Statutes, are amended, and paragraph
20 (f) is added to that subsection, to read:
21 1013.64 Funds for comprehensive educational plant
22 needs; construction cost maximums for school district capital
23 projects.--Allocations from the Public Education Capital
24 Outlay and Debt Service Trust Fund to the various boards for
25 capital outlay projects shall be determined as follows:
26 (6)
27 (b)1. A district school board, including a district
28 school board of an academic performance-based charter school
29 district, must not use funds from the following sources:
30 Public Education Capital Outlay and Debt Service Trust Fund;
31 School District and Community College District Capital Outlay

1 and Debt Service Trust Fund; Classrooms First Program funds
2 provided in s. 1013.68; effort index grant funds provided in
3 s. 1013.73; nonvoted 2-mill levy of ad valorem property taxes
4 provided in s. 1011.71(2); Classrooms for Kids Infrastructure
5 Program funds provided in s. 1013.735; or District Effort
6 Recognition Program funds provided in s. 1013.736 for any new
7 construction of educational plant space with a total cost per
8 student station, including change orders, that equals more
9 than:
10 a. $12,755 for an elementary school,
11 b. $14,624 for a middle school, or
12 c. $19,352 for a high school,

14 (January 2002) as adjusted annually to reflect increases or
15 decreases in the Construction Cost Consumer Price Index and
16 further adjusted by a local geographic factor.
17 2. A district school board must not use funds from the
18 Public Education Capital Outlay and Debt Service Trust Fund or
19 the School District and Community College District Capital
20 Outlay and Debt Service Trust Fund for any new construction of
21 an ancillary plant that exceeds 70 percent of the average cost
22 per square foot of new construction for all schools.
23 (d) The department shall:
24 1. Compute for each calendar year the statewide
25 average construction costs for facilities serving each
26 instructional level, for relocatable educational facilities,
27 for administrative facilities, and for other ancillary and
28 auxiliary facilities. The department shall compute the
29 statewide average costs per student station for each
30 instructional level.

1 2. Annually review the actual completed construction
2 costs of educational facilities in each school district. For
3 any school district in which the total actual cost per student
4 station, including change orders, exceeds the statewide limits
5 established in paragraph (b), the school district shall report
6 to the department the actual cost per student station and the
7 reason for the school district's inability to adhere to the
8 limits established in paragraph (b). The department shall
9 collect all such reports and shall report to the Governor, the
10 President of the Senate, and the Speaker of the House of
11 Representatives by December 31 of each year a summary of each
12 school district's spending in excess of the cost per student
13 station provided in paragraph (b) as reported by the school
14 districts.

16 Cost per student station includes contract costs, legal and
17 administrative costs, fees of architects and engineers,
18 furniture and equipment, and site improvement costs. Cost per
19 student station does not include the cost of purchasing or
20 leasing the site for the construction or the cost of related
21 offsite improvements or parking garages.
22 (f) The commissioner may adopt rules that:
23 1. Set standards for granting waivers from the
24 requirements of this chapter related to cost ceilings for
25 specialized educational centers; and
26 2. Allow the costs associated with unusual site and
27 construction conditions to be deducted from the cost per
28 student station.
29 Section 2. This act shall take effect July 1, 2005.

2 SENATE SUMMARY
3 Provides that the annual adjustment of the maximum
allowable construction cost per student station must be
4 based on the Construction Cost Index and a local
geographic factor, not the Consumer Price Index. Provides
5 that the cost per student station does not include
certain costs related to parking garages. Allows the
6 Commissioner of Education to make rules that set
standards for granting waivers from the requirements of
7 ch. 1013, F.S., related to cost ceilings for specialized
educational centers and rules allowing the costs
8 associated with unusual site and construction conditions
to be deducted from the cost per student station.
