17 and insert:
18 (8) Any person who violates the provisions of this
19 section commits a nonmoving violation, punishable as provided
20 in chapter 318, except that a written warning shall be given
21 for the first violation. However, except for violations of s.
22 316.613 and paragraph (4)(a), enforcement of this section by
23 state or local law enforcement agencies must be accomplished
24 only as a secondary action when a driver of a motor vehicle
25 has been detained for a suspected violation of another section
26 of this chapter, chapter 320, or chapter 322.
27 (9) By January 1, 2006, each law enforcement agency in
28 this state shall adopt departmental policies to prohibit the
29 practice of racial profiling. When a law enforcement officer
30 issues a citation for a violation of this section, the law
31 enforcement officer must record the race and ethnicity of the

1 violator. All law enforcement agencies must maintain such
2 information and forward the information to the department in a
3 form and manner determined by the department. The department
4 shall collect this information by jurisdiction and annually
5 report the data to the Governor, the President of the Senate,
6 and the Speaker of the House of Representatives. The report
7 must show separate statewide totals for the state's county
8 sheriffs and municipal law enforcement agencies, state law
9 enforcement agencies, and state university law enforcement
10 agencies.
11 Section 3. Effective July 1, 2006, subsection (8) of
12 section 316.614, Florida Statutes, as amended by this act, is
13 amended to read:
14 316.614 Safety belt usage.--
15 (8) Any person who violates the provisions of this

24 Section 4. Except as otherwise expressly provided in
