11  Senator Klein moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 1, line 14, through
15            page 2, line 17, delete those lines
16  
17  and insert:  
18         Section 2.  Subsection (8) of section 316.614, Florida
19  Statutes, is amended to read:
20         316.614  Safety belt usage.--
21         (8)  Any person who violates the provisions of this
22  section commits a nonmoving violation, punishable as provided
23  in chapter 318. By January 1, 2006, each law enforcement
24  agency in this state shall adopt departmental policy to
25  prohibit the practice of racial profiling. When a law
26  enforcement officer issues a citation for a violation of this
27  section, the law enforcement officer must record the race and
28  ethnicity of the violator. All law enforcement agencies must
29  maintain such information and forward the information to the
30  department in a form and manner determined by the department.
31  The department shall collect this information by jurisdiction

Florida Senate - 2005 SENATOR AMENDMENT Bill No. CS for SB 216 Barcode 590580 1 and annually report the data to the Governor, the President of 2 the Senate, and the Speaker of the House of Representatives. 3 The report must show separate statewide totals for the state's 4 county sheriffs and municipal law enforcement agencies, state 5 law enforcement agencies, and state university law enforcement 6 agencies. However, except for violations of s. 316.613, 7 enforcement of this section by state or local law enforcement 8 agencies must be accomplished only as a secondary action when 9 a driver of a motor vehicle has been detained for a suspected 10 violation of another section of this chapter, chapter 320, or 11 chapter 322. 12 13 14 ================ T I T L E A M E N D M E N T =============== 15 And the title is amended as follows: 16 On page 1, lines 2-8, delete those lines 17 18 and insert: 19 An act relating to traffic law enforcement; 20 designating the Dori Slosberg Safety Belt Law; 21 amending s. 316.614, F.S.; requiring law 22 enforcement agencies to adopt policies 23 prohibiting racial profiling; requiring law 24 enforcement officers to collect certain 25 information to be forwarded by the agency to 26 the Department of Highway Safety and Motor 27 Vehicles; requiring the department to compile 28 such information and annually submit reports of 29 such data to the Governor and the Legislature; 30 deleting the requirement for enforcement of the 31 Florida Safety Belt Law as a secondary action; 2 10:29 AM 04/26/05 s0216c1c-30-tib
