19 and insert:
20 Section 39. Subsection (2) of section 106.23, Florida
21 Statutes, is amended to read:
22 106.23 Powers of the Division of Elections.--
23 (2) The Division of Elections shall provide advisory
24 opinions when requested by any supervisor of elections,
25 candidate, local officer having election-related duties,
26 political party, political committee, committee of continuous
27 existence, or other person or organization engaged in
28 political activity, relating to any provisions or possible
29 violations of Florida election laws with respect to actions
30 such supervisor, candidate, local officer having
31 election-related duties, political party, committee, person,

1 or organization has taken or proposes to take. Requests for
2 advisory opinions must be submitted in accordance with rules
3 adopted by the Department of State. A written record of all
4 such opinions issued by the division, sequentially numbered,
5 dated, and indexed by subject matter, shall be retained. A
6 copy shall be sent to said person or organization upon
7 request. Any such person or organization, acting in good faith
8 upon such an advisory opinion, shall not be subject to any
9 criminal penalty provided for in this chapter. The opinion,
10 until amended or revoked, shall be binding on any person or
11 organization who sought the opinion or with reference to whom
12 the opinion was sought, unless material facts were omitted or
13 misstated in the request for the advisory opinion.

21 deleting a provision that requires the Division
22 of Elections to retain copies of its advisory
