12  Appropriations (Hill) recommended the following amendment:

14         Senate Amendment (with title amendment) 
15         On page 79, between lines 19 and 20,
16  
17  insert:  
18         Section 47.  Section 104.0615, Florida Statutes, is
19  created to read:
20         104.0615  Voter intimidation or suppression prohibited;
21  criminal penalties.--
22         (1)  This section shall be cited as the "Voter
23  Protection Act."
24         (2)  A person may not directly or indirectly use or
25  threaten to use force, violence, or intimidation or any tactic
26  of coercion or intimidation to induce or compel an individual
27  to:
28         (a)  Vote or refrain from voting;
29         (b)  Vote or refrain from voting for any particular
30  individual or ballot measure;
31         (c)  Refrain from registering to vote; or

Florida Senate - 2005 COMMITTEE AMENDMENT Bill No. CS for SB 2176 Barcode 934008 1 (d) Refrain from acting as a legally authorized 2 election official or poll watcher. 3 (3) A person may not knowingly use false information 4 to: 5 (a) Challenge an individual's right to vote; 6 (b) Induce or attempt to induce an individual to 7 refrain from voting or registering to vote; or 8 (c) Induce or attempt to induce an individual to 9 refrain from acting as a legally authorized election official 10 or poll watcher. 11 (4) A person may not knowingly destroy, mutilate, or 12 deface a voter registration form or election ballot or 13 obstruct or delay the delivery of a voter registration form or 14 election ballot. 15 (5) A person who violates subsection (2), subsection 16 (3), or subsection (4) commits a felony of the third degree, 17 punishable as provided in s. 775.082, s. 775.083, or s. 18 775.084. 19 20 (Redesignate subsequent sections.) 21 22 23 ================ T I T L E A M E N D M E N T =============== 24 And the title is amended as follows: 25 On page 1, line 11, after the semicolon, 26 27 insert: 28 creating s. 104.0615, F.S.; providing a short 29 title; prohibiting a person from using or 30 threatening to use force, violence, or 31 intimidation to induce or compel an individual 2 7:53 AM 04/25/05 s2176c1c-ta01-c7v
