  2         An act relating to enterprise zones; amending

  3         s. 290.00699, F.S.; authorizing Hillsborough

  4         County to apply to the Office of Tourism,

  5         Trade, and Economic Development to amend the

  6         boundary of its enterprise zone; authorizing

  7         the office to approve the amendment to the

  8         boundary lines of the enterprise zone under

  9         certain conditions; authorizing the City of

10         Tampa to apply to the Office of Tourism, Trade,

11         and Economic Development to amend the boundary

12         of its enterprise zone; providing an effective

13         date.

15  Be It Enacted by the Legislature of the State of Florida:

16  

17         Section 1.  Section 290.00699, Florida Statutes, is

18  amended to read:

19         290.00699  Enterprise zone designation for Hillsborough

20  County.--

21         (1)  Hillsborough County may apply to the Office of

22  Tourism, Trade, and Economic Development for designation of

23  one enterprise zone within the county, which zone encompasses

24  a high-crime, low-income, high-unemployment area that is north

25  of Fowler Avenue, south of Bearss Avenue, east of Florida

26  Avenue, west of Bruce B. Downs Boulevard, near the University

27  of South Florida, adjacent to University Square Mall, north of

28  a major theme park, an area that has been designated a federal

29  Weed & Seed target area, and a Community Development Block

30  Grant (CDBG) target area and that houses an active

31  public/private s. 501(c)(3) community development corporation

 1  working to improve the area. The application must be submitted

 2  by December 31, 2002, and must comply with the requirements of

 3  s. 290.0055. Notwithstanding the provisions of s. 290.0065,

 4  limiting the total number of enterprise zones designated and

 5  the number of enterprise zones within a population category,

 6  the Office of Tourism, Trade, and Economic Development may

 7  designate one enterprise zone under this section. The Office

 8  of Tourism, Trade, and Economic Development shall establish

 9  the initial effective date of the enterprise zone designated

10  under this section.

11         (2)  Notwithstanding any other provision of law,

12  Hillsborough County may apply to the Office of Tourism, Trade,

13  and Economic Development to amend the boundary of its existing

14  enterprise zone (EZ-2902). The area proposed for addition to

15  the enterprise zone must not increase the overall size of the

16  enterprise zone by more than 65.907 acres or 0.1 square miles.

17  The boundary expansion area must be contiguous to the existing

18  enterprise zone and consistent with the limitations imposed by

19  s. 290.0055(4). The Office of Tourism, Trade, and Economic

20  Development may approve an amendment to the enterprise zone

21  boundary lines if the application is submitted before December

22  31, 2005, and meets the requirements of this subsection.

23  Before December 31, 2005, the governing body of a county in

24  which an enterprise zone designated under this section is

25  located may apply to the Office of Tourism, Trade, and

26  Economic Development to amend the boundaries of its existing

27  enterprise zone for the purpose of including sections of

28  eligible census tracts which require an interlocal agreement

29  with an adjoining municipality.

30         Section 2.  By December 31, 2005, the City of Tampa may

31  apply to the Office of Tourism, Trade, and Economic

 1  Development to amend the boundaries of its enterprise zone for

 2  the purpose of adding certain eligible areas to the Tampa

 3  Enterprise Zone (EZ-2901). The Office of Tourism, Trade, and

 4  Economic Development shall approve the boundary amendment

 5  application if the boundary amendment is consistent with the

 6  criteria and conditions imposed by section 290.0055, Florida

 7  Statutes, concerning the expansion of an enterprise zone,

 8  including the requirement that the area suffers from pervasive

 9  poverty, unemployment, and general distress.

10         Section 3.  This act shall take effect upon becoming a

11  law.

14                          SENATE SUMMARY

15    Authorizes Hillsborough County and the City of Tampa to
      amend the boundaries of their enterprise zones if
16    approved by the Office of Tourism, Trade, and Economic
      Development. Provides requirements for the amendment to
17    the enterprise zone.
