  1                      A bill to be entitled

  2         An act relating to trust funds; creating s.

  3         947.045, F.S.; creating the Federal Grants

  4         Trust Fund within the Parole Commission;

  5         providing for sources of funds and purposes;

  6         providing for annual carryforward of funds;

  7         providing for future review and termination or

  8         re-creation of the trust fund; providing an

  9         effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Section 947.045, Florida Statutes, is

14  created to read:

15         947.045  Federal Grants Trust Fund.--The Federal Grants

16  Trust Fund is created within the Parole Commission.

17         (1)  Funds to be credited to the trust fund shall

18  consist of receipts from federal grants which shall be used

19  for the various purposes for which the federal funds were

20  intended.

21         (2)  Notwithstanding the provisions of s. 216.301 and

22  pursuant to s. 216.351, any balance in the trust fund at the

23  end of any fiscal year shall remain in the trust fund at the

24  end of the year and shall be available for carrying out the

25  purposes of the trust fund.

26         (3)  In accordance with s. 19(f)(2) of Art. III of the

27  State Constitution, the Federal Grants Trust Fund shall be

28  terminated on July 1, 2009, unless terminated sooner. Before

29  its scheduled termination, the trust fund shall be reviewed as

30  provided in s. 215.3206(1) and (2).

31         Section 2.  This act shall take effect July 1, 2005.
