6 providing for sources of funds and purposes;
7 providing for future review and termination or
8 re-creation of the trust fund; providing an
9 effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 985.4043, Florida Statutes, is
14 created to read:
15 985.4043 Shared County/State Juvenile Detention Trust
16 Fund.--
17 (1) The Shared County/State Juvenile Detention Trust
18 Fund is created within the Department of Juvenile Justice.
19 (2) The fund is established for use as a depository
20 for funds to be used for the costs of predisposition juvenile
21 detention. Moneys credited to the trust fund shall consist of
22 funds from the counties' share of the costs for predisposition
23 juvenile detention.
24 (3) In accordance with s. 19(f)(2), Art. III of the
25 State Constitution, the Shared County/State Juvenile Detention
26 Trust Fund shall, unless terminated sooner, be terminated on
27 July 1, 2009. Before its scheduled termination, the trust fund
28 shall be reviewed as provided in s. 215.3206(1) and (2).
29 Section 2. This act shall take effect July 1, 2005.

COMMITTEE SUBSTITUTE FOR

4 The committee substitute creates the Shared County/State
Juvenile Detention Trust Fund in the Department of Juvenile
5 Justice effective July 1, 2005. Counties' share of cost for
predisposition juvenile detention, to be credited to the trust
6 fund, will comprise the funding. The department will use
these funds to pay for predisposition juvenile detention
7 costs. All revenue remaining in the trust fund at the end of
any fiscal year will be carried forward to the next fiscal
8 year, and the trust fund will be terminated, unless
re-created, on July 1, 2009, pursuant to s. 19(f)(2), Article
9 III, Florida Constitution.
