11  The Committee on Banking and Insurance (Baker) recommended the
12  following amendment:

14         Senate Amendment (with title amendment) 
15         On page 5, between lines 6 and 7,
16  
17  insert:  
18         Section 3.  Section 636.205, Florida Statutes, is
19  created to read:
20         636.205  Issuance of license; denial.--
21         (1)  Following receipt of an application filed pursuant
22  to s. 636.204, the office shall review, and notify the
23  applicant of any deficiencies in, the application. The office
24  shall issue a license to an applicant who has filed a complete
25  application in conformity with s. 636.204, upon payment of the
26  fees specified by s. 636.204, and upon the office being
27  satisfied that the following conditions are met:
28         (a)  The requirements of s. 636.204 are fulfilled.
29         (b)  The entity has the required minimum capital.
30         (c)  The ownership, control, and management of the
31  entity are competent and trustworthy and possess managerial

If the office has good reason to believe 3 that the ownership, control, or management of a discount 4 medical plan organization includes a person whose business 5 operations are or have been marked by business practices or 6 conduct that is to the detriment of the public, stockholders, 7 investors, or creditors, the office may not grant or continue 8 the authority of such organization to transact the business of 9 a discount medical plan organization in this state. 10 (d) The discount medical plan organization has a 11 complaint procedure that will facilitate the resolution of 12 subscriber grievances and that includes, within the 13 organization, formal and informal steps. 14 (e) Any deficiencies identified by the office have 15 been corrected. 16 (f) All requirements of this part are met. 17 (2) If the application for a license is denied, the 18 office shall notify the applicant and shall specify the 19 reasons for denial in the notice. 20 21 (Redesignate subsequent sections.) 22 23 24 ================ T I T L E A M E N D M E N T =============== 25 And the title is amended as follows: 26 On page 1, line 7, after the semicolon, 27 28 insert: 29 creating s. 636.205, F.S.; providing for 30 processing of an application for licensure of a 31 discount medical plan organization by the 2 3:19 PM 04/04/05 s2214c-bi20-tc3
