1 A bill to be entitled
2 An act relating to dental hygienists; amending
3 s. 466.004, F.S.; revising provisions relating
4 to members and meetings of the Council on
5 Dental Hygiene; providing procedures for the
6 council and the Board of Dentistry to consider
7 rule and policy recommendations of the council;
8 amending s. 466.023, F.S.; expanding the scope
9 and area of practice of dental hygienists to
10 include practice with physicians; expanding the
11 scope and area of practice of dental hygienists
12 to include screening and referral of patients
13 for comprehensive dental examinations;
14 providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:
17
18 Section 1. Paragraph (a) of subsection (2) of section
19 466.004, Florida Statutes, is amended to read:
20 466.004 Board of Dentistry.--
21 (2) To advise the board, it is the intent of the
22 Legislature that councils be appointed as specified in
23 paragraphs (a), (b), and (c). The department shall provide
24 administrative support to the councils and shall provide
25 public notice of meetings and agenda of the councils. Councils
26 shall include at least one board member who shall chair the
27 council and shall include nonboard members. All council
28 members shall be appointed by the board chair. Council members
29 shall be appointed for 4-year terms, and all members shall be
30 eligible for reimbursement of expenses in the manner of board
31 members.

1 (a) A Council on Dental Hygiene shall be appointed by
2 the board chair and shall include one dental hygienist member
3 of the board, who shall chair the council, one dental member
4 of the board, and three dental hygienists recommended by the
5 Florida Dental Hygiene Association who are actively engaged in
6 the practice of dental hygiene in this state. The council
7 shall meet at least three times each calendar year. Additional
8 meetings may be called at the request of the board chair, a
9 majority of the members of the board or council, or the
10 council chair. The council is charged with the responsibility
11 of and shall meet for the purpose of developing rules and
12 policies for recommendation to the board, which the board
13 shall consider, on matters pertaining to that part of
14 dentistry consisting of educational, preventive, or
15 therapeutic dental hygiene services; dental hygiene licensure,
16 discipline, or regulation; and dental hygiene education. Rule
17 and policy recommendations of the council shall be considered
18 by the board immediately following the submission of the
19 proposed rule or policy in the same manner as it considers
20 rule and policy recommendations from designated subcommittees
21 of the board. Any rule or policy proposed by the board
22 pertaining to the specified part of dentistry defined by this
23 paragraph shall be referred to the council for a
24 recommendation prior to final action by the board. If the
25 board rejects the council's proposed rule or policy, the board
26 must specify its objection to the council with particularity
27 and include any recommendation it may have for the
28 modification of the proposed rules or policy.
29 Section 2. Subsections (2) and (3) of section 466.023,
30 Florida Statutes, are amended to read:

1 466.023 Dental hygienists; scope and area of
2 practice.--
3 (2) Dental hygienists may perform their duties:
4 (a) In the office of a licensed dentist or physician;
5 (b) In public health programs and institutions of the
6 Department of Children and Family Services, Department of
7 Health, and Department of Juvenile Justice under the general
8 supervision of a licensed dentist or physician; or
9 (c) Upon a patient of record of a dentist or physician
10 who has issued a prescription for the services of a dental
11 hygienist, which prescription shall be valid for 2 years
12 unless a shorter length of time is designated by the dentist
13 or physician, in:
14 1. Licensed public and private health facilities.;
15 2. Other public institutions of the state and federal
16 government.;
17 3. Public and private educational institutions.;
18 4. The home of a nonambulatory patient.; and
19 5. Other places in accordance with the rules of the
20 board.

22 However, the dentist or physician issuing such prescription
23 shall remain responsible for the care of such patient. As used
24 in this subsection, "patient of record" means a patient upon
25 whom a dentist or physician has taken a complete medical
26 history, completed a clinical examination, recorded any
27 pathological conditions, and prepared a treatment plan.
28 (3) Dental hygienists may, without supervision,
29 provide educational programs, faculty or staff training
30 programs, and authorized fluoride rinse programs; screening
31 and referral of patients for comprehensive dental examinations

1 at those facilities, institutions, and places listed under
2 paragraph (2)(c);, and other services which do not involve
3 diagnosis or treatment of dental conditions and which services
4 are approved by rule of the board. Screening results are not a
5 diagnosis for purposes of this chapter and shall be provided
6 to patients assessed or to the parents or guardians of minor
7 patients for a dental referral for diagnosis.
8 Section 3. This act shall take effect July 1, 2005.
