2 An act relating to tuition rates at state
3 colleges and universities; creating s.
4 1009.286, F.S.; requiring students to pay the
5 out-of-state tuition rate for credit hours in
6 excess of a specified number for
7 community-college credits and for overall
8 credits applied to a baccalaureate degree;
9 creating s. 1009.287, F.S.; providing for
10 tuition rebates for students who take minimal
11 excess hours in earning a baccalaureate degree;
12 providing a maximum allowable amount for such a
13 rebate; providing conditions to such a rebate;
14 providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:
17
18 Section 1. Section 1009.286, Florida Statutes, is
19 created to read:
20 1009.286 Additional student payment required for hours
21 exceeding graduation requirements.--
22 (1) It is the intent of the Legislature to discourage
23 undergraduate students in postsecondary education from
24 exceeding the number of credit hours required to complete the
25 students' respective degree programs. Accordingly, a student
26 must pay the out-of-state tuition rate for any credit hours
27 that the student takes in excess of 115 percent of the number
28 of credit hours required to complete the degree program in
29 which he or she is enrolled.
30 (2) A student who is enrolled in a community college
31 must pay the out-of-state tuition rate for credit hours that

1 the student takes in excess of 115 percent of the credit hours
2 required to earn an associate degree, except that a community
3 college student who has earned the associate degree need not
4 pay the full cost for a maximum of 24 hours taken while
5 enrolled at a community college which apply to his or her
6 baccalaureate degree.
7 (3) An undergraduate student who is enrolled in a
8 university that is part of the state university system must
9 pay the out-of-state tuition rate for credit hours that the
10 student takes in excess of 115 percent of the credit hours
11 required to complete the degree program in which he or she is
12 enrolled, regardless of whether those hours were taken while
13 enrolled at a community college, a state university, or any
14 private postsecondary institution if the student received
15 state funds while enrolled at the private postsecondary
16 institution.
17 (4) An undergraduate student who is enrolled in a
18 baccalaureate degree program at a community college must pay
19 the out-of-state tuition rate for credit hours that the
20 student takes in excess of 115 percent of the number of credit
21 hours required to complete the degree program in which he or
22 she is enrolled, regardless of whether those hours were taken
23 while enrolled at a community college, a state university, or
24 any private postsecondary institution if the student received
25 state funds while enrolled at the private postsecondary
26 institution.
27 Section 2. Section 1009.287, Florida Statutes, is
28 created to read:
29 1009.287 Tuition rebates for having minimal excess
30 hours.--

1 (1) A student who has received a baccalaureate degree
2 from a state university in this state is entitled to receive a
3 rebate of 50 percent of any tuition fees that he or she has
4 paid for all undergraduate credit hours in this state if he or
5 she graduates without exceeding by more than 3 credit hours
6 the required number of hours for his or her enrolled degree
7 program.
8 (2) The maximum total amount of a rebate awarded under
9 subsection (1) is $1,000, and a rebate may not be given for
10 any portion of a tuition fee that has been paid by a person or
11 entity other than the student or his or her parent.
12 (3) A student must apply for such a rebate to the
13 State Board of Education on a form devised by the state board
14 and may not apply for the rebate until after he or she has
15 been awarded the baccalaureate degree.
16 (4) Entitlement to the rebate provided for in this
17 section is contingent upon legislative appropriation of
18 funding for the year in which a student graduates and
19 qualifies for the rebate.
20 Section 3. This act shall take effect July 1, 2005.

4 The committee substitute:
5 Requires the 115 percent excess credit hour policy to apply to
students enrolled in a baccalaureate degree program at a
6 community college;
7 Provides that the excess credit hour policy applies to all
associate and baccalaureate degree programs regardless of
8 the number of hours required for completion of the
programs; and
9
Revises the excess credit hour requirements to exclude credit
10 hours taken at postsecondary institutions at which a
student's cost to attend is not being funded or
11 subsidized by the state.
