1 A bill to be entitled
2 An act relating to dart-firing stun guns;
3 creating s. 943.1717, F.S.; providing
4 parameters within which law enforcement,
5 correctional probation and correctional
6 officers may employ dart-firing stun guns;
7 requiring that the Criminal Justice Standards
8 and Training Commission establish standards for
9 instruction in the use of dart-firing stun guns
10 in self defense and in the use of deadly force;
11 requiring that a minimum number of hours in
12 such training be included in the basic-skills
13 course required for certification; providing an
14 effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. Section 943.1717, Florida Statutes, is
19 created to read:
20 943.1717 Use of dart-firing stun guns.--Law
21 enforcement officers', correctional probation officers' and
22 correctional officers' decision to employ the dart-firing stun
23 gun shall involve an arrest or custodial situation wherein the
24 subject is escalating resistance from passive physical
25 resistance towards active physical resistance and the subject:
26 (1) Has the apparent ability to physically challenge
27 the officer, or
28 (2) Is preparing to or is attempting to flee or
29 escape.
30 (3) The Criminal Justice Standards and Training
31 Commission shall establish standards for instructing law

1 enforcement officers in the use of dart-firing stun guns in
2 self defense and in the use of deadly force. Each basic-skills
3 course required for certification as a law enforcement
4 officer, correctional probation officer, or correctional
5 officer must include instruction on the potential effect of
6 dart-firing stun guns on persons under the influence of
7 alcohol or drugs and must be a minimum of 4 hours in duration.
8 Section 2. This act shall take effect upon becoming a
9 law.

COMMITTEE SUBSTITUTE FOR

14 - Requires law enforcement, correctional probation and
correctional officers to take certain conditions into
15 consideration as they make a decision whether to use a
dart-firing stun gun.

- Requires that the training established by the Criminal
17 Justice Standards and Training Commission include
instruction on the potential effect of dart-firing stun
18 guns on persons under the influence of drugs or alcohol.
