  1                      A bill to be entitled

  2         An act relating to cardrooms; amending s.

  3         849.086, F.S.; deleting an exception that

  4         allows pari-mutuel permitholders to operate

  5         cardrooms on certain days when they are not

  6         holding pari-mutuel; providing an effective

  7         date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Paragraph (b) of subsection (7) of section

12  849.086, Florida Statutes, is amended to read:

13         849.086  Cardrooms authorized.--

14         (7)  CONDITIONS FOR OPERATING A CARDROOM.--

15         (b)  A cardroom may be operated at the facility only on

16  days when the facility is authorized to accept wagers on

17  pari-mutuel events during its authorized meet. A cardroom may

18  operate between the hours of 12 noon and 12 midnight on any

19  day a pari-mutuel event is conducted live as a part of its

20  authorized meet. However, a permitholder who holds a valid

21  cardroom license may operate a cardroom between the hours of

22  12 noon and 12 midnight on any day that live racing of the

23  same class of permit is occurring within 35 miles of its

24  facility if no other holder of that same class of permit

25  within 35 miles is operating a cardroom at such time and if

26  all holders of the same class of permit within the 35-mile

27  area have given their permission in writing to the

28  permitholder to operate the cardroom during the designated

29  period. Application to operate a cardroom under this paragraph

30  must be made to the division as part of the annual license

31  application.

 4                          SENATE SUMMARY

 5    Deletes a provision that allows a pari-mutuel
      permitholder to operate cardrooms on days when it is not
 6    holding pari-mutuel events if certain live racing is
      being conducted within 35 miles of the facility and other
 7    conditions are met.
