1 A bill to be entitled
2 An act relating to private donations for public
3 programs and activities; providing legislative
4 intent; providing that a person may make
5 donations to support any activity or program
6 that is funded by the state; requiring that any
7 such donation made to the state be made to the
8 Department of Financial Services; requiring the
9 department to hold the donations until they are
10 distributed; providing for the distribution of
11 the donations; requiring that the donations be
12 held in a trust fund; providing an effective
13 date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Private donations for public programs and
18 activities.--
19 (1)(a) The Legislature finds that each year some
20 individuals voice concerns that certain activities and
21 programs that receive funding from the state are funded at
22 levels below the levels these individuals believe the program
23 or activity needs in order to produce quality results. The
24 Legislature further finds that members of the Legislature
25 often assert that many constituents have expressed the desire
26 and willingness to personally pay higher taxes for certain
27 favored activities or programs.
28 (b) It is the intent of the Legislature that any
29 activity perceived by any person to be inadequately funded may
30 be supported by persons with their own resources in any amount
31 the persons choose to donate.

1 (2) A person may make a designated donation or
2 donations to any activity or program that is funded by the
3 state, in whole or in part, and may donate any amount the
4 person desires and is willing to contribute to the activity or
5 program selected by the donor.
6 (3)(a) A donation to the state shall be made to the
7 Department of Financial Services who shall hold the designated
8 donations until the designated donations are to be
9 distributed. The donations shall be distributed twice each
10 year, at the beginning of the fiscal year immediately
11 following the regular session and December 31st of the same
12 year.
13 (b) The donations must be held in a trust fund created
14 for the purpose of holding designated donations and from which
15 all designated donations will be distributed.
16 Section 2. This act shall take effect July 1, 2005.
