12 following amendment:

15 On page 6, between lines 6 and 7,

17 insert:
18 Section 6. Effective July 1, 2005, section 491.016,
19 Florida Statutes, is created to read:
20 491.016 Professional social work identification.--
21 (1) It shall be a misdemeanor of the first degree,
22 punishable as provided in s. 775.082 or s. 775.083, for a
23 person, for or without compensation, to hold himself or
24 herself out to the public as a social worker either directly
25 or through a governmental or private organization, entity, or
26 agency unless that person:
27 (a) Possesses at least a bachelor's degree in social
28 work from a social work program accredited by, or from an
29 institution that is an active candidate for accreditation as a
30 social work program by, the Council on Social Work Education;

1 (b) Completes, at a university or college outside the
2 United States or Canada, a social work program determined by
3 the Foreign Equivalency Determination Service of the Council
4 on Social Work Education to be equivalent to a bachelor's or
5 master's degree in social work.
6 (2) This section does not apply to a person who, prior
7 to July 1, 2005, used the title "social worker" in his or her
8 employment as long as the person continuously works for the
9 same employer and works in the same capacity for that employer
10 as before July 1, 2005.
11 (3) The department shall adopt rules pursuant to ss.
12 120.536(1) and 120.54 to implement and enforce this section.

26 Health to adopt certain implementing and
27 enforcing rules;
