3 Development Block Grants; amending s. 290.0411,
4 F.S.; stating legislative intent regarding the
5 Small Cities Community Development Block Grant
6 Program; amending s. 290.044, F.S.; providing
7 an additional program category for grants;
8 removing requirement that the Department of
9 Community Affairs provide recommendations to
10 the Legislature as to distribution of federal
11 funds relating to Small Cities Community
12 Development Block Grant Program Fund;
13 authorizing the department to set aside federal
14 funds for a local government for disaster
15 relief; removing provisions limiting a
16 set-aside to certain federal funds; providing
17 an effective date.

19 Be It Enacted by the Legislature of the State of Florida:
20
21 Section 1. Section 290.0411, Florida Statutes, is
22 amended to read:
23 290.0411 Legislative intent and purpose of ss.
24 290.0401-290.049.--It is The intent of the Legislature intends
25 to provide the necessary means to develop, preserve,
26 redevelop, and revitalize Florida communities exhibiting signs
27 of decline or distress by enabling local governments to
28 undertake the necessary community development programs. The
29 overall objective is to create viable communities by
30 eliminating slums and blight; fortifying communities in urgent
31 need; and by providing decent housing and suitable living

1 environments and expanding economic opportunities, principally
2 for persons of low or moderate income. The purpose of ss.
3 290.0401-290.049 is to assist local governments in carrying
4 out effective community development and project planning and
5 design activities to arrest and reverse community decline and
6 restore community vitality. Community development and project
7 planning activities to maintain viable communities, revitalize
8 existing communities, expand economic development and
9 employment opportunities, and improve housing conditions and
10 expand housing opportunities, providing direct benefit to
11 persons of low or moderate income, are the primary purposes of
12 ss. 290.0401-290.049. The Legislature, therefore, declares
13 that the development, redevelopment, preservation, and
14 revitalization of communities in this state and all the
15 purposes of ss. 290.0401-290.049 are public purposes for which
16 public money may be borrowed, expended, loaned, pledged to
17 guarantee loans, and granted.
18 Section 2. Subsections (3) and (4) of section 290.044,
19 Florida Statutes, are amended to read:
20 290.044 Florida Small Cities Community Development
21 Block Grant Program Fund; administration; distribution.--
22 (3) The department shall define the broad community
23 development objective to be achieved by the activities in each
24 of the following grant program categories, and require
25 applicants for grants to compete against each other in these
26 grant program categories:
27 (a) Housing.
28 (b) Economic development.
29 (c) Neighborhood revitalization.
30 (d) Commercial revitalization.
31 (e) Project planning and design.

1 (4) The percentage of funds distributed in each of the
2 grant program categories from federal funds for federal fiscal
3 year 1985 shall be established by the Legislature in the
4 appropriation process for the 1984 regular session and shall
5 be established annually thereafter in the same manner. The
6 department shall submit its recommendation on the distribution
7 percentages to the Governor and Legislature as part of its
8 regular budget proposals. The department may set aside shall
9 provide for the set-aside of an amount of up to 5 10 percent
10 of the federal funds annually allocated to the neighborhood
11 revitalization category in its distribution percentages for
12 use in any eligible local government jurisdiction for which an
13 emergency or natural disaster has been declared by executive
14 order. Such funds may only be provided only to a local
15 government to fund eligible emergency-related activities for
16 which no other source of federal, state, or local disaster
17 funds is available. The department shall provide for such
18 set-aside by rule. In the last quarter of the state fiscal
19 year, any funds not allocated under the emergency-related
20 set-aside must shall be used to fully fund any applications
21 that which were partially funded due to inadequate funds in
22 the most recently completed neighborhood revitalization
23 category funding cycle, and then any remaining funds must
24 shall be distributed to the next unfunded applications.
25 Section 3. This act shall take effect July 1, 2005.
