17 and insert:
18 Section 1. Subsection (5) is added to section 373.118,
19 Florida Statutes, to read:
20 373.118 General permits.--
21 (5) The department shall adopt by rule one or more
22 general permits for local governments to construct, operate,
23 and maintain public marina facilities and public boat ramps,
24 including associated courtesy docks, and associated parking
25 facilities located in uplands. Such general permits adopted by
26 rule shall include provisions to ensure compliance with
27 subsection (1), with part IV, and with the criteria necessary
28 to include the general permits in a state programmatic general
29 permit issued by the United States Army Corps of Engineers
30 under s. 404 of the Clean Water Act, Pub. L. No. 92-500, as
31 amended, 33 U.S.C. ss. 1251 et seq. A facility authorized

1 under such general permits is exempt from review as a
2 development of regional impact if the facility complies with
3 the comprehensive plan of the applicable local government.
4 Such facilities must be consistent with the local government
5 manatee protection plan required pursuant to chapter 370 and
6 must obtain Clean Marina Program status prior to opening for
7 operation and maintain that status for the life of the
8 facility. All facilities, including marinas authorized under
9 any such general permit, shall not exceed an area of 50,000
10 square feet over wetlands and other surface waters. The
11 department shall draft and formally propose the rule
12 authorized under this subsection within 60 days after the
13 effective date of this act.

22 directing the Department of Environmental
23 Protection to adopt rules to authorize local
24 governments to construct and maintain public
25 marinas and boat ramps; providing for the use
26 of submerged lands; providing for regulatory
27 criteria; exempting certain facilities from
28 development-of-regional-impact review;
29 providing an effective date.
