2 An act relating to public marina facilities and
3 boat ramps; amending s. 403.814, F.S.;
4 authorizing the Department of Environmental
5 Protection to allow such facilities or ramps to
6 be constructed and maintained by local
7 governments; providing guidelines and
8 limitations relating to such projects;
9 providing for fees; providing an effective
10 date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsection (12) is added to section
15 403.814, Florida Statutes, to read:
16 403.814 General permits; delegation.--
17 (12) The department shall adopt rules authorizing a
18 general permit providing regulatory and proprietary
19 authorization to local governments for the construction and
20 maintenance of public marina facilities and public boat ramps.
21 Such facilities may preempt no more than 50,000 square feet of
22 sovereign submerged lands and shall be reviewed pursuant to
23 the regulatory criteria in s. 373.414. A public marina
24 facility constructed pursuant to this subsection must obtain
25 Clean Marina Program status within a reasonable time after
26 completion and must maintain such status for the life of the
27 facility. A facility approved pursuant to this subsection is
28 exempt from review as a development of regional impact if the
29 facility complies with the comprehensive plan of the
30 applicable local government. As used in this subsection, the
31 term "public" means the facility or ramp is open to the public

1 on a first-come, first-serve basis with a rental term not to
2 exceed 1 year. A facility or boat ramp constructed pursuant to
3 this subsection may not be sold to a private entity. The state
4 consents to the use of all state lands lying under water which
5 are necessary to accomplish the purposes of this subsection.
6 Fees charged to local governments for preemption of such state
7 lands shall be as set forth in chapter 253 and shall be used
8 to promote boating access in this state.
9 Section 2. This act shall take effect July 1, 2005.

13 Provides for the Department of Environmental Protection
to authorize permits for local governments to construct
14 and maintain public marina facilities and public boat
ramps. Provides guidelines for such projects and
15 authorizes fees.
