15 On page 2, lines 1-16, delete those lines
16
17 and insert:
18 (1) The Legislature finds and declares that there is
19 an insufficient required connection between development and
20 the impacts for which it is assessed; that benefits paid for
21 by impact fees do not always directly benefit the assessed
22 development; and that there is a lack of consistent criteria
23 for the determination of the appropriateness, amount, and
24 collection of impact fees. Consequently, there is a wide
25 disparity developing in the application and relative burden of
26 impact fees in different areas of the state. In some areas of
27 the state, impact fees are driving up the cost of housing to
28 an unreasonable degree, and there is insufficient oversight of
29 local governments that collect and use impact fees. Therefore,
30 it is the intent of the Legislature to ensure that impact fees
31 should only be imposed to offset those capital costs

1 specifically caused by the development for which they are
2 assessed; ensure that the impact fees directly benefit the fee
3 payer; ensure greater consistency in the determination of the
4 appropriateness, amount, and collection of impact fees; ensure
5 flexibility in the timing of payment of impact fees; provide
6 appropriate notice to fee payers of new fees or fee increases;
7 and ensure the accountability of local governments for the
8 collection and expenditure of all impact fees.
