12 the following amendment:

15 On page 3, lines 7 through 9, delete those lines

17 and insert:
18 Section 1. Paragraph (h) is added to subsection (1) of
19 section 400.9935, Florida Statutes, and subsection (13) is
20 added to that section, to read:
21 400.9935 Clinic responsibilities.--
22 (1) Each clinic shall appoint a medical director or
23 clinic director who shall agree in writing to accept legal
24 responsibility for the following activities on behalf of the
25 clinic. The medical director or the clinic director shall:
26 (h) Not engage in the referral of patients to the
27 clinic if the clinic performs magnetic resonance imaging,
28 static radiographs, computed tomography, or positron emission
29 tomography. Referral of patients means the referral of one or
30 more patients of the medical or clinic director or a member of
31 the medical or clinic director's group practice to the clinic

1 for magnetic resonance imaging, static radiographs, computed
2 tomography, or positron emission tomography. A medical
3 director who is found to violate this part commits a felony of
4 the third degree, punishable as provided in s. 775.082, s.
5 775.083, or s. 775.084.

10 On page 1, line 3, after the semicolon,

12 insert:
13 prohibiting a medical director of a clinic from
14 referring patients to the clinic under
15 specified circumstances;
