12 the following amendment:

14 Senate Amendment (with title amendment)
15 On page 34, between lines 3 and 4,
16
17 insert:
18 Section 10. Paragraph (b) of subsection (4) of section
19 497.147, Florida Statutes, is amended to read:
20 497.147 Continuing education; general provisions.--
21 (4)
22 (b) The rules may establish conditions and
23 requirements applicable to providers, including, but not
24 limited to:
25 1. Periodic submission by the provider to the
26 licensing authority of information and documentation as to
27 course materials, class locations and schedules, names of
28 scheduled instructors, resumes of instructors, and
29 descriptions of facilities.
30 2. Requirements for periodic reporting by the provider
31 to the licensing authority of information concerning

1 enrollment, attendance, and status of persons enrolled for
2 credit under this chapter.
3 3. Requirements for inspection by the licensing
4 authority of records of the provider related to training or
5 continuing education of applicants and licensees under this
6 chapter.
7 4. Requirements for announced or unannounced
8 attendance by department staff or board members at scheduled
9 classes or training, for the purpose of ensuring that the
10 training meets the requirements of this chapter and rules
11 adopted under this chapter.
12 5. Requirements for written contracts or agreements
13 required to be entered into by providers with the licensing
14 authority as a prerequisite to acceptance of training or
15 continuing education provided by such provider for credit
16 under this chapter.
17 5.6. Requirements regarding retention of records by
18 the provider regarding training or continuing education for
19 which credit has been given to any licensee under this
20 chapter.
21 6.7. Procedures and criteria for terminating the
22 status of any provider as an approved source of training or
23 continuing education for credit under this chapter.
24 7.8. Requirements for fees to accompany applications
25 from providers for approval or renewal of approval as a
26 provider, not to exceed $250 per year. The rules may exempt
27 nonprofit entities from such fees.
