19 893.1495 Sale of ephedrine and related compounds.--
20 (1) No person shall deliver in any single retail
21 over-the-counter sale any number of packages of any drug
22 containing a sole active ingredient that he or she knows to
23 contain a combined total of more than 9 base grams of
24 ephedrine, pseudoephedrine, phenylpropanolamine, or any of
25 their salts, optical isomers, or salts of optional isomers, or
26 more than three packages in any single retail over-the-counter
27 sale, regardless of weight, containing any such sole active
28 ingredient.
29 (2) Packages of any drug having a sole active
30 ingredient of ephedrine, pseudoephedrine, phenylpropanolamine,
31 or any of their salts or optical isomers shall be displayed

1 and offered for retail sale only behind a checkout counter
2 where the public is not permitted.
3 (3) Any person who is considered the general owner or
4 operator of the retail outlet where ephedrine,
5 pseudoephedrine, or phenylpropanolamine products are available
6 for retail sale shall provide an employee training program
7 that contains instruction on state and federal regulations
8 related to such products to each employee engaged in the
9 retail sale of the products.
10 (4) This section shall supersede any municipal
11 ordinance or regulation passed on or after July 1, 2005, to
12 the extent that such ordinance or regulation is more
13 restrictive than the provisions of this section.
14 (5) A person who violates subsection (1) or subsection
15 (2) shall not be punished for the first violation. A person
16 who violates subsection (1) or subsection (2) commits a
17 misdemeanor of the first degree, punishable as provided in s.
18 775.082 or s. 775.083, for a second offense and, for a third
19 or subsequent offense, commits a felony of the third degree,
20 punishable as provided in s. 775.082, s. 775.083, or s.
