1 A bill to be entitled
2 An act relating to the Cancer Research and
3 Treatment Trust Fund; creating s. 381.926,
4 F.S.; creating the Cancer Research and
5 Treatment Trust Fund within the Department of
6 Health; providing a revenue source for the
7 fund; requiring that moneys in the trust fund
8 be used for the disbursement of grants by the
9 Florida Cancer Council for certain purposes;
10 providing for future review and termination or
11 re-creation of the trust fund; providing a
12 contingent effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Section 381.926, Florida Statutes, is
17 created to read:
18 381.926 Cancer Research and Treatment Trust Fund.--
19 (1) The Cancer Research and Treatment Trust Fund is
20 created within the Department of Health. Funds credited to the
21 trust fund shall consist of moneys provided by law or
22 otherwise appropriated by the Legislature for the purposes
23 prescribed in s. 381.921.
24 (2) In accordance with s. 19(f)(2), Art. III of the
25 State Constitution, the trust fund shall terminate on July 1,
26 2009, unless terminated sooner. Before its scheduled
27 termination, the trust fund shall be reviewed as provided in
28 s. 215.3206.
29 Section 2. This act shall take effect July 1, 2005, if
30 House Bill 1233 or similar legislation is enacted in the same
31 legislative session or an extension thereof and becomes law or

1 if the General Appropriations Act for fiscal year 2005-2006
2 includes funding for the purposes prescribed in s. 381.921,
3 Florida Statutes.
