2 An act relating to education in grades pre-K
3 through 12; amending s. 1003.455, F.S.;
4 requiring that health-related fitness
5 assessments be periodically administered to
6 students; requiring that the fitness-assessment
7 scores be reported to various persons and to
8 the Department of Education; providing
9 requirements for the training of physical
10 education instructors; requiring that school
11 districts have coordinators for physical
12 education and health; providing for recognition
13 awards; requiring that school districts
14 establish wellness policies as federally
15 mandated; requiring the department during
16 school year 2005-2006 to coordinate regional
17 meetings relating to physical education
18 programs; requiring certain public high schools
19 to have a defibrillator on school grounds;
20 providing an effective date.

22 Be It Enacted by the Legislature of the State of Florida:
23
24 Section 1. Subsections (4), (5), (6), (7), and (8) are
25 added to section 1003.455, Florida Statutes, to read:
26 1003.455 Physical education; assessment.--
27 (4)(a) Each physical education instructor shall
28 semiannually administer to his or her students a nationally
29 validated health-related fitness assessment. Training must be
30 provided to ensure appropriate administration of the

1 fitness-assessment instrument and to encourage best practices
2 in physical education instruction.
3 (b) Each school must report its fitness assessment
4 scores to its school improvement team, to the school board,
5 and to the students' parents. Each student and the student's
6 parent or guardian must receive the student's individual
7 results. The district shall report its aggregate results
8 annually to the department.
9 (5) In-service training, preservice training, and
10 teacher certification for physical education instructors must
11 include content related to an integrated curriculum that
12 supports classroom learning, particularly in the areas of
13 reading and math, fitness-based instruction, and connections
14 between movement and learning.
15 (6) Each school district shall appoint or employ a
16 district-level coordinator for physical education and health
17 whose main responsibilities are to develop and maintain
18 high-quality physical education in the district. Small
19 districts may cooperate to provide these services.
20 (7) A system of recognition awards must be established
21 to reward schools and school districts that can demonstrate
22 adequate yearly progress toward improving fitness or
23 connections between improved fitness and academic achievement.
24 These awards may be used for fitness centers, fitness
25 assessment equipment, professional development, or teacher
26 recognition.
27 (8) Each school district must comply with federal
28 requirements relating to the establishment of a wellness
29 policy as required in the reauthorization of the Child
30 Nutrition Act. The policy must address goals for nutrition
31 education, goals for physical activity, nutrition standards,

1 and school-based activities that promote and reinforce
2 wellness messages. The school district shall involve
3 stakeholders in developing the policy, adopt a mechanism for
4 evaluating the policy, and designate at least one person to be
5 responsible for the policy.
6 Section 2. During the 2005-2006 school year, the
7 Department of Education shall coordinate a series of regional
8 meetings that bring together various stakeholders to develop
9 partnerships, discuss issues, provide workshops, and showcase
10 exemplary programs relating to physical education for students
11 in prekindergarten through grade 12. Participants in the
12 regional meetings should include school-level and
13 district-level personnel; county and municipal parks and
14 recreation personnel; providers of after-school care, such as
15 Boys Clubs, Girls Clubs, and the YMCA; parent groups; business
16 groups; and health care providers.
17 Section 3. Each public high school that has athletic
18 facilities or participates in interscholastic sports shall
19 have an operational defibrillator on the high school grounds.
20 Section 4. This act shall take effect July 1, 2005.
