3 s. 39.01, F.S., relating to proceedings
4 relating to children; amending s. 827.01, F.S.,
5 relating to abuse of children; providing an

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (47) of section 39.01, Florida
11 Statutes, is amended to read:
12 39.01 Definitions.--When used in this chapter, unless
13 the context otherwise requires:
14 (47) "Other person responsible for a child's welfare"
15 includes the child's legal guardian, legal custodian, or
16 foster parent; an employee of a private school, public or
17 private child day care center, residential home, institution,
18 facility, or agency; a law enforcement officer or employee of
19 a municipal or county detention facility or of the Department
20 of Corrections while acting in an official capacity, public
21 school volunteer, religious organization volunteer, health
22 care provider, or any other person legally responsible for the
23 child's welfare in a residential setting; and also includes an
24 adult sitter or relative entrusted with a child's care. For
25 the purpose of departmental investigative jurisdiction, this
26 definition does not include law enforcement officers, or
27 employees of municipal or county detention facilities or the
28 Department of Corrections, while acting in an official
29 capacity.
30 Section 2. Subsection (1) of section 827.01, Florida
31 Statutes, is amended to read:

1 827.01 Definitions.--As used in this chapter:
2 (1) "Caregiver" means a parent, adult household
3 member, law enforcement officer or employee of a municipal or
4 county detention facility or of the Department of Corrections
5 while acting in an official capacity, public school volunteer,
6 religious organization volunteer, health care provider, or
7 other person responsible for a child's welfare.
8 Section 3. This act shall take effect upon becoming a
9 law.

12 SENATE SUMMARY
13 Defines the terms "other person responsible for a child's
welfare" and "caregiver" to include a law enforcement
14 officer, public school volunteer, a religious
organization volunteer, a health care provider for
15 purposes of ch. 39, Florida Statutes.
