  2         An act relating to cardrooms; amending s.

  3         849.086, F.S.; revising definitions to include

  4         dominoes as an authorized game and to allow

  5         games other than card games to be played in

  6         cardrooms; authorizing rulemaking relating to

  7         poker and dominoes by the Division of

  8         Pari-mutuel Wagering of the Department of

  9         Business and Professional Regulation; providing

10         for supervision of dominoes games at a

11         cardroom; limiting wagering related to

12         authorized games; providing an effective date.

14  Be It Enacted by the Legislature of the State of Florida:

15  

16         Section 1.  Paragraphs (a) and (c) of subsection (2),

17  paragraph (a) of subsection (4), paragraph (c) of subsection

18  (7), and paragraph (a) of subsection (8) of section 849.086,

19  Florida Statutes, are amended to read:

20         849.086  Cardrooms authorized.--

21         (2)  DEFINITIONS.--As used in this section:

22         (a)  "Authorized game" means a game or series of games

23  of poker or dominoes which are played in a nonbanking manner.

24         (c)  "Cardroom" means a facility where authorized card

25  games are played for money or anything of value and to which

26  the public is invited to participate in such games and charged

27  a fee for participation by the operator of such facility.

28  Authorized games and cardrooms do not constitute casino gaming

29  operations.

30         (4)  AUTHORITY OF DIVISION.--The Division of

31  Pari-mutuel Wagering of the Department of Business and

 1  Professional Regulation shall administer this section and

 2  regulate the operation of cardrooms under this section and the

 3  rules adopted pursuant thereto, and is hereby authorized to:

 4         (a)  Adopt rules, including, but not limited to: the

 5  issuance of cardroom and employee licenses for cardroom

 6  operations; the operation of a cardroom; the review and

 7  approval of the play and wagering in a game or series of games

 8  of poker or a game of dominoes; recordkeeping and reporting

 9  requirements; and the collection of all fees and taxes imposed

10  by this section.

11         (7)  CONDITIONS FOR OPERATING A CARDROOM.--

12         (c)  A cardroom operator must at all times employ and

13  provide a nonplaying dealer for each table on which authorized

14  card games which traditionally utilize a dealer are conducted

15  at the cardroom. A cardroom operator must at all times employ

16  and provide a nonplaying supervisor for each table on which an

17  authorized dominoes game is conducted at the cardroom. Such

18  dealers or dominoes game supervisors may not have any

19  participatory interest in any game other than the dealing of

20  cards or the supervision of dominoes games and may not have an

21  interest in the outcome of the game. The providing of such

22  dealers or dominoes games supervisors by a licensee shall not

23  be construed as constituting the conducting of a banking game

24  by the cardroom operator.

25         (8)  METHOD OF WAGERS; LIMITATION.--

26         (a)  No wagering may be conducted using money or other

27  negotiable currency. Games may only be played utilizing a

28  wagering system whereby all players' money is first converted

29  by the house to tokens or chips which shall be used for

30  wagering only at that specific cardroom. No wager of money or

31  any other property or thing of value may be made on the

 1  outcome of an authorized game other than by the persons who

 2  are playing in such a game or in a series of such games. Any

 3  wager authorized by this paragraph must be in strict

 4  compliance with this subsection.

 5         Section 2.  This act shall take effect July 1, 2005.

 7          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
 8                         Senate Bill 2432

 9                                 

10  The committee substitute allows the Division of Pari-mutuel
    Wagering of the Department of Business and Professional
11  Regulation (division) to adopt rules for the review and
    approval of the play and wagering in a game or series of games
12  of poker or a game of dominoes.

13  The committee substitute provides that a cardroom operator
    must at all times employ and provide a nonplaying,
14  nonparticipating supervisor for each table on which an
    authorized dominoes game is conducted at the cardroom.  The
15  providing of dominoes games does not constitute conducting a
    banking game by the cardroom operator.

    The committee substitute provides that a wager of money or any
17  other property or thing of value may be made on the outcome of
    an authorized game only by the players.  Any wager must be in
18  strict compliance with the provisions of the act.
