14 On page 1, between lines 26 and 27,

16 insert:
17 Section 1. Restoration activities for the Lake
18 Okeechobee Restoration Program managed by the Department of
19 Environmental Protection, the Department of Agriculture and
20 Consumer Services, the Fish and Wildlife Conservation
21 Commission, or the South Florida Water Management District are
22 exempt from the competitive-procurement requirements in
23 section 287.057, Florida Statutes, and must comply with
24 section 377.11, Florida Statutes, to the extent that such
25 entities award proposed construction, operations, and
26 maintenance work to the lowest responsible bidder or the
27 lowest evaluated responsible bidder in a time-plus-money
28 contract. The contract may provide for an incentive payment
29 to the contractor for early completion of the project or
30 critical phases of the work and for damages to be assessed
31 against the contractor for the completion of the project or

1 critical phases of the work after the time specified for such
2 completion. Regardless of the option elected, the protest
3 procedures in section 120.57(3), Florida Statutes, apply to
4 all such contracts.

11 On page 1, lines 2 through 3, delete those lines,

13 and insert:
14 An act relating to water resource management;
15 exempting contracts relating to the Lake
16 Okeechobee Restoration Program that are
17 administered by the Department of Environmental
18 Protection, the Department of Agriculture and
19 Consumer Services, the Fish and Wildlife
20 Conservation Commission, or the South Florida
21 Water Management District from certain
22 contracting requirements; authorizing incentive
23 payments to the contractor for early
24 completion; authorizing damages against
25 contractor for tardy completion; applying
26 bid-protest procedures in s. 120.57(5), F.S.,
27 to such contracts; amending s. 373.036, F.S.;
