  1                      A bill to be entitled

  2         An act relating to school-based health care;

  3         creating the School-Based Health-Care Task

  4         Force; providing for appointment of members;

  5         providing responsibilities; requiring a report

  6         to the Governor and the Legislature by a

  7         specified date; providing for staffing;

  8         providing an effective date.

  9  

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  School-Based Health-Care Task Force.--

13         (1)  The School-Based Health-Care Task Force is

14  established within the Department of Education for the purpose

15  of facilitating and encouraging development of comprehensive

16  primary-health centers in public elementary, middle, and high

17  schools to provide preventive health services, acute

18  primary-health-care services, chronic-disease treatment and

19  management services, case management, counseling, and

20  appropriate referral of specialty health-care services. After

21  submitting its final report on or before December 31, 2005,

22  the task force is dissolved.

23         (2)  The task force consists of 15 members:

24         (a)  Two Senators appointed by the President of the

25  Senate, one of whom shall be designated to chair the task

26  force;

27         (b)  A Senator appointed by the Minority Leader of the

28  Senate;

29         (c)  A member of the House of Representatives appointed

30  by the Speaker of the House of Representatives;

 1         (d)  A member of the House of Representatives appointed

 2  by the Minority Leader of the House of Representatives;

 3         (e)  The Secretary of Health, or his or her designee;

 4         (f)  The Secretary of Health Care Administration, or

 5  his or her designee;

 6         (g)  The Commissioner of Education, or his or her

 7  designee;

 8         (h)  A school board member or designee from a district

 9  currently representing school-based health centers, appointed

10  by The Florida School Boards Association, Inc.;

11         (i)  A community-based member appointed by the Florida

12  Coalition of School Based Health Care or its designee;

13         (j)  A representative of an academic institution,

14  hospital, or a hospital associated with a school-based health

15  center;

16         (k)  A person appointed by the Florida Association of

17  Health Maintenance Organizations;

18         (l)  A person appointed by the Florida Association of

19  Community Health Centers, Inc.;

20         (m)  A person appointed by the Florida Rural Health

21  Association; and

22         (n)  A representative of health insurance companies

23  appointed by the Chief Financial Officer.

24         (2)  The task force shall meet at the call of the

25  chair. The first meeting of the task force shall be held in

26  Tallahassee no later than July 15, 2005.

27         (3)  The task force shall:

28         (a)  Identify and examine existing programs, services,

29  laws, and rules regarding the availability and coverage of

30  health-care services for public-school students.

 1         (b)  Receive and consider reports and testimony from

 2  individuals, educators, county health departments,

 3  community-based organizations, and other public and private

 4  organizations.

 5         (c)  Develop a comprehensive School-Based Health-Care

 6  Plan and present its final report and recommendations to the

 7  Governor, the President of the Senate, and the Speaker of the

 8  House of Representatives by December 31, 2005. The

 9  School-Based Health-Care Plan shall address:

10         1.  Providing school-based health center services as a

11  means of extending access to care for medically underserved

12  children across the state;

13         2.  Providing a role for school-based health centers as

14  a safety-net provider within the state;

15         3.  Inclusion of the school-based-health-center model

16  in statewide health-planning activities and mandatory federal

17  health plans, including the state's Title V long-term

18  strategic plan, as appropriate;

19         4.  The relationship of school-based health centers to

20  integrated-services initiatives, including

21  prevention/wellness; chronic-disease management; and mental

22  health;

23         5.  The relationship of school-based health centers to

24  insurance and other reimbursement mechanisms, including

25  Medicaid and the Florida Kidcare program;

26         6.  The feasibility of establishing standards of care

27  and procedures for statewide certification of school-based

28  health centers; and

29         7.  Development of long-term funding strategies to

30  ensure adequate financial support for school-based health

31  centers.

 1         (4)  Members of the task force serve without

 2  compensation, and the cost of members' participation shall be

 3  borne by their appointing organization. Any member who is a

 4  public employee is entitled to reimbursement for per diem and

 5  travel expenses by the appointing department in accordance

 6  with section 112.061, Florida Statutes.

 7         (5)  The Department of Education shall provide

 8  logistical and staff support for the task force.

 9         Section 2.  This act shall take effect upon becoming a

10  law.
