  1                      A bill to be entitled

  2         An act relating to interstate highway safety;

  3         creating the interstate highway traffic safety

  4         priority program area in the Department of

  5         Transportation Highway Safety Grant Program;

  6         providing requirements for awarding grants;

  7         amending s. 318.18, F.S.; providing for a

  8         surcharge for disposition of traffic

  9         infractions; amending s. 318.21, F.S.;

10         providing for distribution of the surcharge;

11         providing an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Interstate highway safety grants.--An

16  interstate highway traffic safety priority program area is

17  added to the Department of Transportation Highway Safety Grant

18  Program. Grants awarded under this priority program area shall

19  be available to any law enforcement agency with jurisdiction

20  to enforce traffic laws on an interstate highway. Grants under

21  this program area shall be awarded using the same procedures

22  and criteria used for other program areas, as applicable,

23  except that grants under this program area must be used for

24  interstate highway traffic safety to assist in addressing

25  traffic safety deficiencies, expand an ongoing activity, or

26  develop a new program related to interstate highway traffic

27  safety.

28         Section 2.  Subsection (14) is added to section 318.18,

29  Florida Statutes, to read:

 1         318.18  Amount of civil penalties.--The penalties

 2  required for a noncriminal disposition pursuant to s. 318.14

 3  are as follows:

 4         (14)  In addition to any penalties imposed for

 5  noncriminal traffic infractions pursuant to this chapter, a

 6  $20 surcharge shall be paid for each infraction and shall be

 7  distributed as provided under s. 318.21(13).

 8         Section 3.  Subsection (13) is added to section 318.21,

 9  Florida Statutes, to read:

10         318.21  Disposition of civil penalties by county

11  courts.--All civil penalties received by a county court

12  pursuant to the provisions of this chapter shall be

13  distributed and paid monthly as follows:

14         (13)  The additional surcharge on traffic infractions

15  provided for under s. 318.18(14) shall be collected and

16  remitted by the clerk of the court to the Department of

17  Revenue to be distributed as follows:

18         (a)  Ten dollars of each surcharge collected shall be

19  distributed to the Department of Transportation Highway Safety

20  Grant Program to enhance funds available for grant awards

21  under the interstate highway traffic safety priority program

22  area.

23         (b)  Ten dollars of each surcharge collected shall be

24  deposited into the General Revenue Fund to be used to improve

25  highway safety and enhance traffic law enforcement on

26  interstate highways.

27         Section 4.  This act shall take effect July 1, 2005.
