  1                      A bill to be entitled

  2         An act relating to private school bus drivers;

  3         amending s. 1002.42, F.S.; providing

  4         requirements for private school bus drivers,

  5         including specified qualifications, drug and

  6         alcohol testing, background screening, and

  7         certain registration or licensure; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  Subsection (14) of section 1002.42, Florida

13  Statutes, is amended to read:

14         1002.42  Private schools.--

15         (14)  BUS DRIVER REQUIREMENTS AND TRAINING.--

16         (a)  Each private school bus driver must be of good

17  moral character, have good vision and hearing, and be

18  able-bodied, free from communicable disease, mentally alert,

19  and sufficiently strong physically to handle the bus with

20  ease; must possess other qualifications described in 49 C.F.R.

21  part 391, relating to physical qualifications and

22  examinations, and in 49 C.F.R. parts 40 and 382, relating to

23  controlled substance and alcohol use and testing; must meet

24  level 2 background screening standards set forth in chapter

25  435; and must hold a valid chauffeur registration or a valid

26  commercial driver's license with a passenger endorsement.

27         (b)  Private school bus drivers may participate in a

28  district school board's bus driver training program, if the

29  district school board makes the program available pursuant to

30  s. 1012.45(4).

31         Section 2.  This act shall take effect July 1, 2005.
