  1                      A bill to be entitled

  2         An act relating to for-hire bus drivers;

  3         creating s. 125.5805, F.S.; requiring counties

  4         to adopt ordinances relating to registration of

  5         drivers who transport school students for hire;

  6         providing specified qualifications, including

  7         background screening and commercial driver

  8         licensure; providing for applicability;

  9         providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Section 125.5805, Florida Statutes, is

14  created to read:

15         125.5805  For-hire bus drivers; transport of school

16  students; required local ordinances; minimum requirements;

17  reimbursement of costs; exclusion.--

18         (1)  No later than January 1, 2006, all counties must

19  adopt an ordinance that requires every driver of a motor

20  vehicle that is regularly used for the transportation of

21  students to or from school, or to or from school activities,

22  who receives compensation for such services to register with

23  the county.

24         (2)  The ordinance shall require, at a minimum, that

25  each driver provide documentation that the driver:

26         (a)  Has met level 2 background screening standards set

27  forth in chapter 435; and

28         (b)  Holds a valid commercial driver's license with a

29  passenger endorsement.

 1         (3)  Each driver shall reimburse the county for any

 2  costs of background screening or for any other expenses

 3  related to administration of the ordinance.

 4         (4)  The provisions of this section do not apply to

 5  drivers employed by a public school or private school who meet

 6  the requirements of s. 1012.45 or s. 1002.42.

 7         Section 2.  This act shall take effect July 1, 2005.

 9          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
10                         Senate Bill 2478

12  The committee substitute requires counties to adopt an
    ordinance for the registration of for-hire bus drivers who
13  transport students.  The committee substitute also:

14       -Requires a driver to provide specific proof at the time
         of registration with the county and to reimburse the
15       county for administrative expenses.

16       -Provides an exception to the registration requirements
         for drivers who meet specific criteria.
