2 An act relating to qualified job training
3 organizations; creating s. 288.1171, F.S.;
4 defining the term "qualified job training
5 organization"; providing for the Office of
6 Tourism, Trade, and Economic Development to
7 certify qualified job training organizations;
8 providing for the distribution of certain funds
9 to a certified organization; specifying uses of
10 the funds; authorizing the Auditor General to
11 audit such organizations for certain purposes;
12 providing for revocation of certification under
13 certain circumstances; providing for
14 appropriations to be distributed through the
15 Florida Goodwill Association; providing an
16 effective date.

18 Be It Enacted by the Legislature of the State of Florida:
19
20 Section 1. Section 288.1171, Florida Statutes, is
21 created to read:
22 288.1171 Qualified job training organizations;
23 certification; duties.--
24 (1) For purposes of this section, the term "qualified
25 job training organization" means an organization that:
26 (a) Is a Goodwill Industries located in this state.
27 (b) Is exempt from income taxation under s. 501(c)3 or
28 s. 501(c)4 of the Internal Revenue Code of 1986, as amended.
29 (c) Specializes in the retail sale of donated items.
30 (d) Provides job training and employment services to
31 individuals who have workplace disadvantages and disabilities.

1 (e) Uses a majority of its revenues for job training
2 and placement programs that create jobs and foster economic
3 development.
4 (2) To be eligible for funding as provided in this
5 act, an organization must be certified by the Office of
6 Tourism, Trade, and Economic Development as meeting the
7 criteria specified in subsection (1).
8 (3) After a qualified job training organization is
9 certified, the organization shall use proceeds provided in
10 this act solely to encourage and provide economic development
11 through capital construction, improvements, or equipment which
12 will result in expanded employment opportunities.
13 (4) The Auditor General may audit a qualified job
14 training organization to verify that the distributions to the
15 organization under this section have been expended by the
16 organization as required under this section. If the Auditor
17 General determines that the distributions have not been
18 expended as required under this section, the Office of
19 Tourism, Trade, and Economic Development may pursue recovery
20 of such proceeds pursuant to the laws and rules governing the
21 assessment of taxes.
22 (5) Failure to use the proceeds as provided in this
23 section constitutes grounds for revoking certification.
24 Section 2. There is appropriated 3 million dollars per
25 year from nonrecurring general revenue for 10 years to the
26 Office of Tourism, Trade, and Economic Development for the
27 purpose specified in section 228.1171(3), Florida Statutes.
28 For the 2005-2006 fiscal year, these funds are appropriated
29 from nonrecurring general revenue. For the fiscal years
30 2006-2010, the funds appropriated shall be appropriated from
31 nonrecurring general revenue or as specifically provided in

1 the General Appropriations Act. The funds so appropriated
2 shall be distributed by the Office of Tourism, Trade, and
3 Economic Development to the Florida Goodwill Association for
4 distribution to local community Goodwill Industries solely to
5 encourage and provide economic development through capital
6 construction, improvements, or equipment that will result in
7 expanded employment opportunities.
8 Section 3. This act shall take effect July 1, 2005.
