1 A bill to be entitled
2 An act relating to water management districts;
3 amending s. 373.1501, F.S.; defining projects;
4 authorizing the South Florida Water Management
5 District to acquire land by eminent domain to
6 implement such projects; requiring that each
7 water management district establish a program
8 to encourage small businesses, including
9 businesses that are owned by women and
10 minorities, to participate in the procurement
11 and contract activities of the district;
12 requiring that the districts adopt rules to
13 administer the program; providing an effective
14 date.

16 Be It Enacted by the Legislature of the State of Florida:
17
18 Section 1. Paragraphs (l) and (m) are added to
19 subsection (1) of section 373.1501, Florida Statutes, and
20 subsection (3) of that section is amended, to read:
21 373.1501 South Florida Water Management District as
22 local sponsor.--
23 (1) As used in this section and s. 373.026(8), the
24 term:
25 (l) "Biscayne Bay Coastal Wetlands Phase 1 Project -
26 C-1 Cutler Wetlands Component" means the C-1 Cutler Wetlands
27 Component in the Biscayne Bay Coastal Wetlands Phase 1
28 Acceler8 Project approved by the South Florida Water
29 Management District governing board on November 9, 2004. A map
30 showing the C-1 Cutler Wetlands Component is on file with the
31 clerk of the South Florida Water Management District.

1 (m) "C-111 Spreader Canal Project" means the C-111
2 Spreader Canal Project described in the Final Integrated
3 Feasibility Report and Programmatic Environmental Impact
4 Statement for the Central and Southern Florida Project
5 Comprehensive Review Study, dated April 1999, and authorized
6 by the Congress through the Water Resources Development Act of
7 2000, s. 601(b)(2)(C)(x).
8 (3) The Legislature declares that the Kissimmee River
9 Project, the Ten Mile Creek Project, the Water Preserve Areas,
10 the Southern Corkscrew Regional Ecosystem Watershed Project,
11 the Pal-Mar Project, and the C-111 Project, the C-111 Spreader
12 Canal Project, and the Biscayne Bay Coastal Wetlands Phase 1
13 Project - C-1 Cutler Wetlands Component are in the public
14 interest, for a public purpose, and necessary for the public
15 health and welfare. The governing board of the district is
16 empowered and authorized to acquire fee title or easement by
17 eminent domain for the limited purposes of implementing the
18 Kissimmee River Project, the Ten Mile Creek Project, the Water
19 Preserve Areas, the Southern Corkscrew Regional Ecosystem
20 Watershed Project, the Pal-Mar Project, and the C-111 Project,
21 the C-111 Spreader Canal Project, and the Biscayne Bay Coastal
22 Wetlands Phase 1 Project - C-1 Cutler Wetlands Component. Any
23 acquisition of real property, including by eminent domain, for
24 those objectives constitutes a public purpose for which it is
25 in the public interest to expend public funds. Notwithstanding
26 any provision of law to the contrary, such properties shall
27 not be removed from the district's plan of acquisition, and
28 the use of state funds for these properties is authorized. In
29 the absence of willing sellers, any land necessary for
30 implementing the projects in this subsection shall be acquired

1 in accordance with state condemnation law pursuant to chapters
2 73 and 74.
3 Section 2. Small business program.--Each water
4 management district shall establish and administer a program
5 to encourage small businesses, including businesses that are
6 owned by women and minorities, to participate in the
7 procurement and contract activities of the water management
8 district. The purpose of the program is to stimulate economic
9 development and enable small businesses, including businesses
10 that are owned by women and minorities, to successfully expand
11 in the marketplace. Each district shall adopt rules under
12 section 373.113, Florida Statutes, to administer the program.
13 Section 3. This act shall take effect upon becoming a
14 law.

17 SENATE SUMMARY
18 Authorizes the South Florida Water Management District to
acquire land by eminent domain to implement specified
19 projects. Requires the water management districts to
establish a small business program for the purpose of
20 encouraging small businesses, including businesses that
are owned by women and minorities, to participate in the
21 procurement and contract activities of the districts.
