  1                      A bill to be entitled

  2         An act relating to higher education; amending

  3         s. 1009.21, F.S.; classifying certain student

  4         athletes at community colleges and state

  5         universities as residents for tuition purposes;

  6         providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Paragraph (l) is added to subsection (10)

11  of section 1009.21, Florida Statutes, to read:

12         1009.21  Determination of resident status for tuition

13  purposes.--Students shall be classified as residents or

14  nonresidents for the purpose of assessing tuition in community

15  colleges and state universities.

16         (10)  The following persons shall be classified as

17  residents for tuition purposes:

18         (l)  A person who has been properly classified as a

19  student athlete in an athletic program recognized by the

20  National Collegiate Athletic Association, for the duration of

21  the person's athletic eligibility.

22         Section 2.  This act shall take effect July 1, 2005.

25                          SENATE SUMMARY

26    Provides that a student athlete who is in an athletic
      program recognized by the National Collegiate Athletic
27    Association at a community college or a state university
      is a resident of this state for tuition purposes for the
28    duration of the person's athletic eligibility.
