A bill to be entitled
2An act relating to professions regulated by the Department
3of Business and Professional Regulation; amending s.
4455.271, F.S.; providing for the reinstatement of certain
5voided licenses; providing requirements for application
6and reinstatement of voided licenses, including fees,
7continuing education, and eligibility; providing an
8effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Subsection (6) of section 455.271, Florida
13Statutes, is amended to read:
14     455.271  Inactive and delinquent status.--
15     (6)(a)  A delinquent status licensee must affirmatively
16apply with a complete application, as defined by rule of the
17board, or the department if when there is no board, for active
18or inactive status during the licensure cycle in which a
19licensee becomes delinquent. Failure by a delinquent status
20licensee to become active or inactive before the expiration of
21the current licensure cycle shall render the license void null
22without any further action by the board or the department. Any
23subsequent licensure shall be as a result of applying for and
24meeting all requirements imposed on an applicant for new
25licensure.
26     (b)  Notwithstanding the provisions of the professional
27practice acts administered by the department, the board, or the
28department if there is no board, may, at its discretion,
29reinstate the license of an individual whose license has become
30void if the board or department, as applicable, determine that
31the individual has made a good-faith effort to comply with this
32section but has failed to comply because of illness or unusual
33hardship. The individual must apply to the board, or the
34department if there is no board, for reinstatement in a manner
35prescribed by rules of the board or the department, as
36applicable, and shall pay an applicable fee in an amount
37determined by rule. The board, or the department if there is no
38board, shall require that such individual meet all continuing
39education requirements prescribed by law, pay appropriate
40licensing fees, and otherwise be eligible for renewal of
41licensure under this chapter.
42     Section 2.  This act shall take effect July 1, 2005.
