1 A bill to be entitled
2 An act relating to payments in lieu of taxes;
3 amending s. 373.59, F.S.; deleting a 10-year
4 limitation on such payments; subjecting such
5 payments to certain indexes used by the
6 Governor in funding rural initiatives; amending
7 s. 373.5905, F.S., to conform; providing an
8 effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Paragraph (b) of subsection (10) of section
13 373.59, Florida Statutes, is amended, and paragraph (h) is
14 added to that section, to read:
15 373.59 Water Management Lands Trust Fund.--
16 (10)
17 (b) Payment in lieu of taxes shall be available:
18 1. To all counties that have a population of 150,000
19 or fewer. Population levels shall be determined pursuant to s.
20 11.031.
21 2. To all local governments located in eligible
22 counties and whose lands are bought and taken off the tax
23 rolls.

25 For properties acquired after January 1, 2000, in the event
26 that such properties otherwise eligible for payment in lieu of
27 taxes under this subsection are leased or reserved and remain
28 subject to ad valorem taxes, payments in lieu of taxes shall
29 commence or recommence upon the expiration or termination of
30 the lease or reservation, but in no event shall there be more
31 than a total of 10 annual payments in lieu of taxes for each

1 tax loss. If the lease is terminated for only a portion of the
2 lands at any time, the 10 annual payments shall be made for
3 that portion only commencing the year after such termination,
4 without limiting the requirement that 10 annual payments shall
5 be made on the remaining portion or portions of the land as
6 the lease on each expires. For the purposes of this
7 subsection, "local government" includes municipalities, the
8 county school board, mosquito control districts, and any other
9 local government entity which levies ad valorem taxes.
10 (h) Payments in lieu of taxes made pursuant to this
11 subsection shall be subject to the same indexes the Governor
12 uses for funding rural initiatives.
13 Section 2. Section 373.5905, Florida Statutes, is
14 amended to read:
15 373.5905 Reinstitution of payments in lieu of taxes;
16 duration.--If a water management district has made a payment
17 in lieu of taxes to a governmental entity and subsequently
18 suspended such payment, the water management district shall
19 reinstitute appropriate payments and continue the payments in
20 consecutive years until the governmental entity has received a
21 total of 10 payments for each tax loss.
22 Section 3. This act shall take effect July 1, 2005.
