11  Senator Smith moved the following amendment:
12  
13         Senate Amendment (with title amendment) 
14         On page 46, lines 4-30, delete those lines
15  
16  and insert:  
17         (6)  The legislature budget commission may approve
18  adjustments to the clerk's maximum annual budget for
19  court-related duties if either of the following conditions
20  exist:
21         (a)  The additional funding is necessary to pay the
22  cost of performing new or additional functions required by
23  changes in law or court rule. Before the maximum annual budget
24  of any clerk can be increased, the Clerk ofo the Court
25  corporation shall provide the legislative budget commission a
26  statement of the impact of the proposed budget changes on
27  state revenues, and evidence that the respective clerk of the
28  court is meeting or exceeding the established performance
29  standards for measures on the fiscal management, operational
30  efficiency, and effective collection of fines, fees, service
31  charges, and court costs.

 1         (b)  The additional funding is necessary to pay the
 2  cost of supporting increases in the number of judges or
 3  magistrates authorized by the Legislature. Before the maximum
 4  annual budget of any clerk can be increased. The Clerk of the
 5  Court Corporation shall provide the legislative budget
 6  commission a statement of the impact of the proposed budget
 7  changes on state revenues, evidence that the respective clerk
 8  of the court is meeting or exceeding the established
 9  performance standards for measures on the fiscal management,
10  operational efficiency, and effective collection of fines,
11  fees, service charges, and court costs, and a proposed
12  staffing model, including the cost and number of staff
13  necessary to support each new judge or magistrate.
