11  The Committee on Justice Appropriations (Smith) recommended
12  the following amendment:

14         Senate Amendment (with title amendment) 
15         On page 100, between lines 16 and 17,
16  
17  insert:  
18         Section 63.  (1)(a)  The Legislature finds that the use
19  of estimates of prior-year expenditures to establish maximum
20  annual budgets for the county fiscal year 2004-2005 resulted
21  in maximum annual budgets for some clerks of court which were
22  less than the amounts would have been if actual prior-year
23  expenditures had been used.
24         (b)  The Legislature further finds that the clerks of
25  court perform duties critical to the operations of the
26  judicial branch and that future maximum annual budgets for the
27  clerks of court are based in part on their prior-year budgets.
28         (c)  The Legislature further finds that the difference
29  between establishing the maximum annual budget using estimated
30  prior-year expenditures and using actual prior-year
31  expenditures was significant for the Clerk of Court for the

 1  Eleventh Judicial Circuit.
 2         (2)  Therefore, the maximum annual budget for the Clerk
 3  of Court for the Eleventh Judicial Circuit is increased by
 4  $3,817,115 for the county fiscal year 2004-2005.
