11  Senator Smith moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 98, lines 11-14, delete those lines
15  
16  and insert:  
17         Section 58.  Section 903.286, Florida Statutes, is
18  created to read:
19         903.286  Return of cash bond; requirement to withhold
20  unpaid fines, fees, and court costs.--Notwithstanding the
21  provisions of s. 903.31(2), the clerk of the court shall
22  withhold from the return of a cash bond posted on behalf of a
23  criminal defendant by a person other than a bail bond agent
24  licensed pursuant to chapter 648 sufficient funds to pay any
25  unpaid court fees, court costs, and criminal penalties. In the
26  event that sufficient funds are not available to pay all
27  unpaid court fees, court costs, and criminal penalties, the
28  clerk of the court shall immediately obtain payment from the
29  defendant or enroll the defendant in a payment plan pursuant
30  to s. 28.246.
