11  The Committee on Justice Appropriations (Smith) recommended
12  the following amendment:
13  
14         Senate Amendment (with title amendment) 
15         On page 47, between lines 2 and 3,
16  
17  insert:  
18         Section 15.  Section 28.44, Florida Statutes, is
19  created to read:
20         28.44  Clerk discontinuance of court-related
21  functions.--
22         (1)  A function of the clerk of court being performed
23  in support of the trial courts by the individual clerks of
24  court on July 1, 2004, may not be discontinued or
25  substantially modified on a unilateral basis except pursuant
26  to this section. A clerk of court may discontinue performing a
27  function performed in support of the trial court only if:
28         (a)  The chief judge of the circuit has consented in
29  writing to the discontinuance or substantial modification of
30  the function performed in support of the trial court; or
31         (b)  The clerk of court has given written notice of the

 1  intention to substantially modify or discontinue a function
 2  performed in support of the trial court at least 1 year before
 3  the effective date of the discontinuance or substantial
 4  modification of the function.
 5         (2)  "Substantial modification" of a function performed
 6  in support of the trial court means a modification which has
 7  the effect of reducing the level of services provided to the
 8  trial court.

15         On page 5, line 5, after the semicolon,

17  insert:
18         creating s. 28.44, F.S.; providing a method by

21         providing a definition;
