11  Senator Smith moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 98, between lines 14 and 15, insert:
15         Section 58.  Section 903.286, Florida Statutes, is
16  created to read:
17         903.286  Return of cash bond; requirement to withhold
18  unpaid fines, fees, and court costs.--Notwithstanding the
19  provisions of s. 903.31(2), the clerk of the court shall
20  withhold from the return of a cash bond posted on behalf of a
21  criminal defendant by a person other than a bail bond agent
22  licensed pursuant to chapter 648 sufficient funds to pay any
23  unpaid court fees, court costs, and criminal penalties. In the
24  event that sufficient funds are not available to pay all
25  unpaid court fees, court costs, and criminal penalties, the
26  clerk of the court shall immediately obtain payment from the
27  defendant or enroll the defendant in a payment plan pursuant
28  to s. 28.246.
