  1                      A bill to be entitled

  2         An act relating to limitation on liability for

  3         persons or political subdivisions providing

  4         street lights, security lights, or other

  5         similar illumination; creating s. 768.1382,

  6         F.S.; providing that a person or political

  7         subdivision that provides, operates, or

  8         maintains street lights or other similar

  9         illumination is not liable for civil damages

10         for injury or death effected or caused by the

11         adequacy or failure of illumination of the

12         lights, regardless whether the adequacy or

13         failure of illumination is alleged or

14         demonstrated to have caused or contributed in

15         any way to the injury or death; providing an

16         effective date.

18  Be It Enacted by the Legislature of the State of Florida:

19  

20         Section 1.  Section 768.1382, Florida Statutes, is

21  created to read:

22         768.1382  Limitation on liability for persons or

23  political subdivisions providing street lights, security

24  lights, or other similar illumination; no duty owed to

25  provide, operate, or maintain illumination.--Any person, as

26  defined in s. 1.01, or any political subdivision, as defined

27  in s. 1.01, which provides, operates, or maintains street

28  lights, security lights, or other similar illumination may not

29  be held liable for any civil damages for injury or death

30  effected or caused by the adequacy or failure of illumination

31  of the lights, regardless of whether the adequacy or failure

 1  of illumination is alleged or demonstrated to have caused or

 2  contributed in any way to the injury or death. No person,

 3  corporation, municipality, political subdivision, or other

 4  entity that provides, operates, or maintains a manner of

 5  illumination described in this section owes a duty to the

 6  public to provide, operate, or maintain the illumination in

 7  any manner.

 8         Section 2.  This act shall take effect upon becoming a

 9  law and shall apply to all cases pending or filed on or after

10  the effective date of this act.

13                          SENATE SUMMARY

14    Provides that any person or political subdivision that
      provides, operates, or maintains street lights or other
15    similar illumination is not liable for civil damages for
      injury or death effected or caused by the adequacy or
16    failure of illumination of the lights, regardless of
      whether the adequacy or failure of illumination is
17    alleged or demonstrated to have caused or contributed in
      any way to the injury or death.
