11  Senators Smith and Saunders moved the following amendment to
12  substitute amendment (240980):

14         Senate Amendment (with title amendment) 
15         On page 1, line 15, through
16            page 2, line 2, delete those lines
17  
18  and insert:  
19         On page 2, lines 1-15, delete those lines
20  
21  and insert:
22         (2)  Notwithstanding any law to the contrary, in order
23  to maintain a class action seeking monetary relief, the class
24  must allege and prove actual damages. In any such class
25  action, the monetary recovery shall be limited to equitable
26  relief, if appropriate, and the amount of actual damages.
27  Nothing in this section shall be construed to limit or
28  restrict the ability of the Attorney General to bring a class
29  action for the recovery of statutory penalties, if otherwise
30  authorized by law. However, class action claimants may seek to
31  obtain, if appropriate, nonmonetary relief, including
