11  Senators Smith and Aronberg moved the following amendment:
12  
13         Senate Amendment (with title amendment) 
14         On page 1, line 19, through
15            page 2, line 15, delete those lines
16  
17  and insert:  
18         (1)  In any action asserting the right to class action
19  status, the claimant class with capacity to sue shall be
20  limited to residents of this state at the time of the alleged
21  misconduct, except as provided in subsection (2).
22         (2)  Prior to issuance of the certification order, the
23  court may expand a class to include any nonresident whose
24  claim is recognized within the claimant's state of residence
25  and is not time-barred, but whose rights cannot be asserted
26  because the claimant's state of residence lacks personal
27  jurisdiction over the defendant or defendants. In addition,
28  the claimant class may include nonresidents if the conduct
29  giving rise to the claim occurred in or emanated from this
30  state.
